Business Meeting
Roll Call – Councilors Graney, McNabb, Smith, Dempsey and Mayor Lattimore, present.  

Staff Members Present – Mark Palesh, City Manager, Debra McCormick City Clerk, Lisa Green, Comptroller, John Rossi, Corporation Counsel.

All stood for the Pledge of Allegiance to the Flag.

Mayor Lattimore asks for a moment of silence.  

Public to be Heard –
Betty Smith, Arlington Ave. – spoke to Council about the problem her neighborhood is having with pit bulls that are owned by a neighbor.

 Cathy Banfield, 12 Arlington  Ave. – spoke to Council about the aggressive pit bulls that live on her street.  She asked what could be done to stop the barking and running loose.

Mike Wolzek, 33 Arlington Ave. spoke to Council regarding the same issue with pit bulls.  

Mary Jane Pethybridge, Arlington Ave. spoke to Council about the problem with pit bulls.

Robert Hunter, 33 Gaylord St. comment about the previous times he spoke at Council on October 11, and 28th regarding the city’s sale of property on McGarr St. and the land sale policy.

Robert Adams, 30 Arlington Ave. spoke about the barking pit bulls on his street.

Mayor Lattimore asked the City Clerk to comment on what the Clerk’s office and Dog Control Officer have done for the Arlington Ave. residents regarding the pit bulls owned by a resident of Arlington Ave.  Ms. McCormick reported that all possible actions allowed by the City’s ordinances have been taken to address the problem.  Council discussed the issue and it was agreed that the City’s Ordinance would be evaluated for changes to strengthen some of the laws regarding dangerous and barking dogs.

Presentation of Petition and Communications    - The Clerk read.

Ordinances – The City Clerk read Ordinance #19 of 2007 amending Chapter 285 of the City Code entitled “Vehicles and Traffic” for a first reading.

Resolutions

Award Resolution # 207 of 2007 authorizing award of bid for the purchase of equipment to install LED Obstruction Lights on the tower located at 85 Osborne St. Auburn NY to Finger Lakes Communications of Auburn NY for the low bid of $6,178.75.  VOTE: Councilor Graney, McNabb, Smith, Dempsey and Mayor Lattimore, aye.  PASSED.


Land Transfer Resolution #208 of 2007 authorizing the Mayor to execute any and all necessary documents for the sale of a landlocked parcel located at 75 R Chapman Ave. to Ms. Theresa (Filkins) Dempsey.  VOTE: Councilor Graney, McNabb, Smith, Dempsey and Mayor Lattimore, aye.  PASSED.  (Councilor Dempsey stated he is no relation to the purchaser.)

Agreement Resolution #209 of 2007 amending Agreement between the Auburn Downtown Business Improvement District and the City of Auburn.  VOTE: Councilor Graney, McNabb, Smith, Dempsey and Mayor Lattimore, aye.  PASSED.

Council Resolution # 210 of 2007 authorizing that the regular meeting scheduled for Thursday November 22, 2007 be changed to Tuesday November 20, 2007 at 4:00PM due to the Thanksgiving Holiday. VOTE: Councilor Graney, McNabb, Smith, Dempsey and Mayor Lattimore, aye.  PASSED.
Council Resolution #211 of 2007 authorizing the Mayor to enter into a lease agreement with New Cingular Wireless PCS d/b/a Cellular One for tower space on the tower owned by the City he of Auburn located at 85 Osborne St. VOTE: Councilor Graney, McNabb, Smith, Dempsey and Mayor Lattimore, aye.  PASSED.

Council Resolution # 212 of 2007 opposing New York State DEC proposed Permit Limits for Phosphorous Discharge from the upgrade Village of Groton NY Sewage Treatment Plant into the Owasco Lake Inlet and Owasco Lake. VOTE: Councilor Graney, McNabb, Smith, Dempsey and Mayor Lattimore, aye.  PASSED.

Land Sale Resolution #213 of 2007 authorizing the Mayor to sign all documents required to transfer 28 Bradley St. Auburn New York to the Auburn Industrial Development Authority for the sum of $2500.  VOTE: Councilor Graney, McNabb, Smith, Dempsey and Mayor Lattimore, aye.  PASSED.

Other Business – Councilor McNabb asked for information regarding the mailing that was sent by the city to residents (voters) regarding the referendum to eliminate the Civil Service Commission from the City Charter that was on the ballot during this past election. He asked who approved it, who is paying for it, and who printed it. He asked why city funds were used for such a mailing.  And stated that taxpayers should not have to pay for it.  Mayor Lattimore and the City Manager responded.
